Terms of use of the service
These terms of use constitute a contractual agreement between you and QUANTYCA SOFTWARE SOLUTIONS, SL. They govern access to and use of the Ubyquo platform, accessible at https://www.ubyquo.com and through the associated Navegadoc and Ubyquo applications.
Definitions
- Account: all users belong to a customer account. If a user accesses for the first time without a prior invitation, they will be considered the administrator of the associated account.
- User: is the natural person who accepts these terms of service, by the mere fact of registering with the service through the website or through the Ubyquo and/or Navegadoc applications.
- Services: services are all the functionalities offered to users directly on the website or through the software applications developed and distributed under the Ubyquo brand.
Browsing rules
Access to Ubyquo is voluntary. QUANTYCA reserves the right to modify these terms at any time. Users must make proper use of the services and register by providing truthful information.
User registration and sign-up
Registration is carried out personally through the website, the applications or by invitation. The user must provide truthful, up-to-date and lawful information. Passwords are personal and non-transferable, and the user is solely responsible for keeping them safe. Registration on this platform is prohibited for persons under eighteen (18) years of age.
User types
- Administrator user: is the user who has full control over the account, including the management of the other users.
- Other users: are users with limited privileges in terms of their functionalities; they cannot invite other users or configure file sharing.
Account types
- Basic account: is created at the time of registration and allows a given number of documents to be managed with no time limit.
- Paid account: is the account contracted under one of the plans detailed in the modules, under the conditions set out therein.
The service is suspended when the user exceeds the contracted limits; accounts revert to the basic type once the payment period has ended.
Right of exclusion
QUANTYCA reserves the right to withdraw, restrict and/or deny access to the platform for legal or security reasons, or for reasons relating to specific domains or countries.
The services
The services depend on the account type and are linked to an email address. QUANTYCA cannot guarantee security with respect to user accounts shared by several people.
The following uses are expressly prohibited:
- Resale or redistribution of the service without authorization.
- Modification of or damage to the platform.
- Carrying out criminal or terrorist activities.
- Sharing files protected by copyright without holding the corresponding rights.
Confidentiality
QUANTYCA is limited to providing an information hosting and synchronization service, applying the security measures necessary to protect it.
Cost of the service
Access to the Ubyquo website, and some of its services, are free of charge, with the exception of the paid account types, which are subject to the specific conditions of each plan.
Links
QUANTYCA assumes no responsibility for third-party websites that link or refer to Ubyquo.
Intellectual property
The texts, drawings, photographs and any audiovisual element of Ubyquo are the exclusive property of QUANTYCA SOFTWARE SOLUTIONS, SL. The user may not reproduce, distribute or transform the content of the platform without express written authorization.
Software applications
QUANTYCA grants the user a non-exclusive, non-transferable license to use the Ubyquo and Navegadoc applications. The user may not modify, adapt, sell, lease or sublicense said applications. The platform may make use of third-party software, subject to its own terms and conditions.
Industrial property
QUANTYCA owns the industrial property rights over the distinctive signs used, or holds the corresponding licenses for the use of third-party signs.
Privacy
The privacy conditions are governed separately and are accessible through the Privacy Policy. Certain external providers support the platform's services; the user authorizes the storage of their data on QUANTYCA's own systems or on the systems of the providers contracted by QUANTYCA.
Termination of the service
QUANTYCA reserves the right to modify, suspend or cancel the services provided through Ubyquo at any time.
Platform maintenance
QUANTYCA carries out maintenance and update tasks that may temporarily suspend the service, and will endeavor to give appropriate advance notice of this.
Warranties and liabilities
QUANTYCA does not guarantee the absence of errors in access to the platform, or the uninterrupted provision of the service, and is not liable for system errors, loss of data or third-party claims arising from the use of the platform.
Governing law and jurisdiction
These terms are governed by Spanish law, and the parties submit, for any dispute arising from them, to the Courts and Tribunals of Madrid.
Amendments
QUANTYCA SOFTWARE SOLUTIONS, SL. reserves the right to make any changes it considers necessary to these terms of use without prior notice to the user.
